The Durban High Court has ruled in favour of the eThekwini Ratepayers Protest Movement (ERPM), to ditch the 6 kilolitres back billing charge.
The Municipality implemented billing adjustments on residents’ accounts, since December 2023.
An elated Assad Gaffar, Chairperson of the ERPM, said in a statement on Wednesday “our heartfelt thanks to our legal team, driven by Norton Rose Fullbright’s Sandile Khoza, Heinrich Nienaber and Advocates Warren Shapiro and Fezeka Khuzwayo.”
He also said this latest judgement sends a clear message to the Muni that such behaviour will not be tolerated.
“This judgement is a testament to our unwavering commitment to fight the rights of our members and the broader community…”
It is unclear if the eThekwini Municipality will appeal the decision.
