The Joburg High Court has ordered the City of Joburg to begin the validation process of informal traders, removed in parts of the inner City in October.

The court said the process must be fair, non-discriminatory and comply with the constitution.

The Socio-Economic Rights Institute (SERI), brought an urgent application before the Courts, representing the traders.

The City said this ruling by Judge Brad Wanless, affirms the City’s constitutional right to uphold its by-laws, restore order and execute its strategic developmental agenda without undue impediment.

Speaking on behalf of the City, Dr Mgcini Tshwaku, MMC of public safety in Johannesburg, said “De Villiers Street had become a disaster waiting to happen, due to uncontrollable crowds, escalating crime rates, litter accumulation and the presence of undocumented foreigners, posing a clear security risk.”
